{"id":3818,"date":"2022-02-15T00:37:54","date_gmt":"2022-02-15T03:37:54","guid":{"rendered":"https:\/\/creci-al.gov.br\/portal\/?p=3818"},"modified":"2022-02-15T00:37:54","modified_gmt":"2022-02-15T03:37:54","slug":"artigo-graduacao-para-corretores-de-imoveis","status":"publish","type":"post","link":"https:\/\/creci-al.gov.br\/portal\/artigo-graduacao-para-corretores-de-imoveis\/","title":{"rendered":"ARTIGO\/Gradua\u00e7\u00e3o para Corretores de Im\u00f3veis"},"content":{"rendered":"<p style=\"text-align: left\"><em>Jo\u00e3o Teodoro, presidente do Sistema Cofeci Creci apresenta um hist\u00f3rico sobre a regulamenta\u00e7\u00e3o da profiss\u00e3o e como a forma\u00e7\u00e3o foi importante para as conquistas da categoria e para seu futuro!<\/em><\/p>\n<p>A profiss\u00e3o de Corretor de Im\u00f3veis foi regulamentada no Brasil por meio da Lei n\u00ba<\/p>\n<p>4.116, de 27 de agosto de 1962. Neste ano, portanto, completaremos 60 anos de regulamenta\u00e7\u00e3o legal, para felicidade de todos os que amam esta atividade. N\u00e3o foi f\u00e1cil! A referida Lei foi vetada pelo Presidente Jo\u00e3o Goulart e devolvida ao Congresso Nacional. Mas o ent\u00e3o deputado Ulisses Guimar\u00e3es, de S\u00e3o Paulo, adotou sua paternidade e, com o apoio de aguerridos colegas daquela \u00e9poca, derrubou o veto presidencial e a Lei foi promulgada.<\/p>\n<p>Em lugar do Presidente da Rep\u00fablica, subscreveu a Lei 4.116\/1962 o ent\u00e3o Senador e Presidente do Congresso, Auro de Moura Andrade. Entretanto, 14 anos depois, em 1976, a Lei foi declarada inconstitucional pelo STF, deixando \u00f3rf\u00e3os de regulamenta\u00e7\u00e3o os Corretores de Im\u00f3veis. O principal motivo da declara\u00e7\u00e3o de inconstitucionalidade foi o fato de que a Lei n\u00e3o exigia qualquer escolaridade, nem mesmo o grau fundamental. E muito menos forma\u00e7\u00e3o t\u00e9cnica. Al\u00e9m do mais, a profiss\u00e3o era considerada meramente laboral, e n\u00e3o intelectual.<\/p>\n<p>Todavia, ainda em 1976, um Mandado de Seguran\u00e7a impetrado por nossos l\u00edderes da \u00e9poca conseguiu suspender provisoriamente os efeitos da declara\u00e7\u00e3o de inconstitucionalidade. Ent\u00e3o, sob as b\u00ean\u00e7\u00e3os do saudoso ministro do trabalho, o ga\u00facho Arnaldo da Costa Prieto, um novo projeto de lei foi elaborado e enviado ao Congresso, como mensagem presidencial. Era Presidente da Rep\u00fablica o General Ernesto Geisel. No dia 12 de maio de 1978, depois de aprovada pelo Senado e pela C\u00e2mara dos Deputados, foi sancionada a Lei n\u00ba 6.530.<\/p>\n<p>A regulamenta\u00e7\u00e3o legal da profiss\u00e3o foi uma incomensur\u00e1vel vit\u00f3ria da classe, nem sempre compreendida. Ainda h\u00e1 colegas que abominam pagar uma \u00fanica taxa anual, esquecendo-se de que \u00e9 ela que sustenta nossa organiza\u00e7\u00e3o e garante a reserva do exerc\u00edcio profissional exclusivamente para quem \u00e9 inscrito no Creci. Sem ela, qualquer cidad\u00e3o, sem qualquer obriga\u00e7\u00e3o legal ou moral, poderia ser corretor. A profiss\u00e3o deixaria de existir. Mas ainda \u00e9 pouco. Precisamos do reconhecimento social. Por isso, \u00e9 importante a gradua\u00e7\u00e3o dos corretores de im\u00f3veis.<\/p>\n<p>A exig\u00eancia da forma\u00e7\u00e3o superior n\u00e3o implicar\u00e1 perda de direitos de quem j\u00e1 exerce a profiss\u00e3o. Independentemente de ter ou n\u00e3o gradua\u00e7\u00e3o. Somente os que forem inscritos a partir da vig\u00eancia da modifica\u00e7\u00e3o legal \u00e9 que ter\u00e3o restringidas suas atribui\u00e7\u00f5es. Isso ser\u00e1 necess\u00e1rio para que o profissional graduado possa sentir-se valorizado por seu esfor\u00e7o. Por outro lado, quem n\u00e3o tiver a gradua\u00e7\u00e3o se sentir\u00e1 motivado a graduar-se. Nossa compet\u00eancia para avaliar im\u00f3veis vem sendo contestada justamente porque a lei n\u00e3o nos exige o curso superior.<\/p>\n<p>A Argentina, por exemplo, n\u00e3o tem de lei federal que estabele\u00e7a reserva de mercado, mas as leis regionais exigem forma\u00e7\u00e3o superior para o exerc\u00edcio da corretagem imobili\u00e1ria. Tamb\u00e9mn\u00e3o h\u00e1 de se falar em anuidades diferenciadas para quem n\u00e3o \u00e9 graduado. Na corretagem de im\u00f3veis n\u00e3o se remunera por sal\u00e1rio, mas por percentual. Todos t\u00eam direito a ison\u00f4mica remunera\u00e7\u00e3o.
